Fuel Goods services are provided by Fuel Better, Inc. (“Fuel Goods”, “fuel goods” “we” “us” or “our”). These terms of use (these “Terms”) govern your (“you” or “your”) access to and use of the fuelgoods.com website (the “Website”) and all services provided by us via the Website including without limitation our subscriptions and gift service (collectively, the “Services”).
By accessing, browsing or using this Site, you acknowledge that you have read, understood and agreed to be bound by these Terms of Use (these “Terms”). If you do not agree to these Terms, you should not use or access this Website.
SCOPE OF SERVICE
Fuel Goods maintains this Website as a service to the user community that visits the Website subject to these Terms and Conditions of Use. You are responsible for obtaining any equipment and Internet service necessary to access our Website and for paying any fees for the equipment and service you select. We may alter, suspend, or discontinue this Website or the Services in whole or in part, at any time and for any reason, without notice. The Website may also periodically become unavailable due to maintenance or malfunction of computer equipment or for other reasons.
USE LICENSE
a) Permission is granted to temporarily download one copy of the materials (information or software) on Fuel Goods’s website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

Any claim relating to Fuel Goods’s website shall be governed by the laws of the State of Florida without regard to its conflict of law provisions.
SUBSCRIPTIONS, PRODUCTS & SALES
To begin a Fuel Goods subscription and order, you must enter your information on our Website. All information provided to us is governed by our Privacy Policy. It is your responsibility to keep registration information current through the account page on the Website.
As a customer, you agree to receive promotional emails with special offer(s) by both Fuel Goods and third parties. This includes our newsletter. You may choose not to receive these emails by unsubscribing through the link in applicable e-mail correspondence.
DELIVERY
As a subscriber, you will receive a shipment every at the frequency determined at checkout containing the same or different items including, but not limited to, nutrition bars, chews, personal care, athletic accessories, protein shakes/supplements, energy boosters, and healthy snacks (“Products”). Products are subject to change. Accordingly, there is no guarantee that a Product will be available during a certain time period or in a subsequent time frame. Furthermore, use of all Products is exclusively at the customer’s risk. You expressly agree to hold harmless the Company from and against all claims, liens, damages, liabilities of any kind.
BILLING AND PAYMENTS
During the order and subscription process you will select which one-time purchase, plan or plans you wish to order. In turn, Fuel Goods will deliver products to you at the frequency and price that you choose. You acknowledge that there is no guarantee to the value of products contained within your shipment.
You must register a payment instrument and authorize Fuel Goods to charge all amounts billed to you under this Agreement, both initial and renewal, to such instrument. The registration of the payment instrument constitutes your authorization to charge, in accordance with the terms of the applicable subscription plan until you terminate your account, and you further agree to pay any charges so incurred. If you use the Website to purchase a Subscription, you are required to promptly update your account information with any changes (for example, a change in your billing address or credit card expiration date) that may occur. All payments made are non-refundable. Any disputed charges must be reported to Fuel Goods within thirty (30) days after the date or the charge. If you do not receive a product you have been charged for, please contact us at support@fuelgoods.com. We reserve the right to change subscription plan prices. In such event, Fuel Goods will provide notice of the change at least 30 days before the change is to take effect. Continuing to use the Service after the price change constitutes your agreement to pay the updated amount.
For the sake of security, we use a third party payment service to process credit card information. You agree that Fuel Goods will not be held liable for any failures of the third party to adequately protect such information. You acknowledge that Fuel Goods may switch the third party payment service and move your information to other service providers that encrypt your information using secure socket layer technology (SSL) or other comparable security technology.
SHIPPING AND RISK OF LOSS
Unless otherwise indicated at the time of your purchase, shipping and handling fees are included with your order. Shipping dates and/or arrival times are only estimates. Claims of loss or damage must be reported to Fuel Goods within 30 days of the date of your purchase.
Replacement of Products and credits to your account for shipped merchandise claimed as not received are subject to our investigation, which may include postal-service notification. If delivery verification is confirmed by the carrier, we will consider your package delivered. If a package is deemed delivered, adjustments to your account will be provided at our discretion. Repeated claims of undelivered merchandise may result in the cancellation of your membership.
If a subscriber provides incorrect address information or fails to update their shipping address which results in a shipment being returned to our warehouse, the subscriber will be notified by our customer service team. The subscriber can either a) have the package resent paying an shipping cost or b) opt to have the shipment refunded less the original shipping costs plus a 10% restocking fee.
RETURNS AND EXCHANGES
Defective Products may be returned for replacement or refund. In the event that a refund is needed, please contact us at support@fuelgoods.com. When returning Products, it is the responsibility of the sender to take reasonable care to see that the Products are not damaged in transit and are delivered to the designated address. All refunds are subject to our return and exchange policies stated on our FAQ, if any. Please note credits resulting from the subscription charge are only available up to 30 days past the date of the charge. Refunds are at the sole discretion of Fuel Goods.
CANCELLATIONS
One-time purchases can be cancelled by contacting support@fuelgoods.com so long as the order has not yet been shipped from the warehouse. Subscriptions can be cancelled at any time through your account on the Website or by emailing support@fuelgoods.com. Membership changes and cancellations will take effect immediately for all Products that have not yet been billed to you as of the time and date of the cancellation request. All products already billed at the time of the cancellation will be sent as scheduled. Exceptions to this rule will be made at the discretion of The Fuel Goods and are no way guaranteed. If an exception is granted, a 10% restocking fee will be assessed.
SUBMITTED CONTENT
By submitting content on the Website, you grant Fuel Goods a perpetual, irrevocable, non-terminable, worldwide, royalty-free and non-exclusive license to use, copy, distribute, publicly display, modify, create derivative works, and sublicense such materials or any part of such materials. You hereby represent, warrant and covenant that any materials you provide do not include anything (including, but not limited to, text, images, music or video) to which you do not have the full right to grant Fuel Goods the license specified above. You further represent, warrant and covenant that any materials you provide will not contain libelous or otherwise unlawful, abusive or obscene material. Fuel Goods will be entitled to use any content submitted by you without incurring obligations of confidentiality, attribution or compensation to you.
DISCLAIMER OF WARRANTY
YOU ARE SOLELY RESPONSIBLE FOR DETERMINING IF THE PRODUCTS ARE SUITABLE FOR USE OR CONSUMPTION. FUEL GOODS IS NOT ABLE TO PROVIDE ANY GUARANTEES REGARDING ALLERGIES.
Under no circumstances will we be liable for any loss or damage caused by your use of the Products or your reliance on information in any Content on this Website.
SEVERABILITY
If any part of these Terms and Conditions is held to be unlawful, void, or unenforceable, that part will be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
ENTIRE AGREEMENT
These Terms and Conditions constitute the entire agreement between the parties relating to the subject matter herein. We may, at our sole discretion and without notice, revise these terms at any time by updating this posting.
